Terms and Conditions of Sale – Tartufi Marzoli

1. Introduction

These Terms and Conditions of Sale (“Terms”) govern all purchases made through the Tartufi Marzoli website, sole proprietorship of Fabio Marzoli, located at Via Generale Guisan 1, 6833 Vacallo (TI), Switzerland (hereinafter “we”, “our” or “the Company”).

By using our website and purchasing our products, the user (“Customer”) fully accepts these Terms.

Tartufi Marzoli specialises in the sale and distribution of fresh truffles, truffle-based products, and high-quality gourmet specialties, intended both for professional catering and culinary enthusiasts.


2. E-commerce Platform

Our online store is built on the Shopify platform.
All products available for purchase are described on their respective pages, including information on:

  • Technical and descriptive features

  • Seasonal availability of fresh truffles

  • Storage instructions

  • Usage advice and pairings

We reserve the right to modify product information at any time, including availability, prices, and descriptions, without prior notice.


3. Purchase Process

To purchase Products, the Customer must complete and submit the electronic order form following the instructions on the Site. The Customer must add the Product to the “cart” and, after reviewing and accepting these Terms, enter the shipping and billing details, select the desired payment method, and confirm the order.

By submitting the order through the Site, which constitutes a contractual offer, the Customer acknowledges that they have read all instructions provided during the purchase process and fully accept these General and Payment Terms.

The contract between Tartufi Marzoli and the Customer is concluded upon acceptance of the order by Tartufi Marzoli. This acceptance is communicated via an order confirmation email containing a reference to these Terms, the order number, shipping and billing information, a list of ordered Products with their essential characteristics, and the total price, including delivery charges. The Customer must review the confirmation email and, if any errors are identified, contact Customer Service within 6 hours using the “Contact” section of the Site and indicate the order number.

After this time, the order will be processed for shipment and no further modifications will be accepted.

Upon receiving the order, Tartufi Marzoli will verify stock availability. If one or more Products are unavailable, Tartufi Marzoli will promptly notify the Customer by email, who will then have 6 hours to confirm shipment of available Products or cancel the order. If no response is received within this period, the order will be considered confirmed and available Products will be shipped. If only some Products are out of stock, Tartufi Marzoli will ship the available Products. In both cases, the amount for unavailable Products will be immediately refunded according to the selected payment method.


3.1 Product Information

Product information and features, including product codes, are available on the Site.

Visual representations of Products on the Site, where available, correspond generally to the photographs accompanying the product description. Images are intended solely for presentation purposes and may not perfectly represent the Product’s characteristics or quality, which may vary in colour and size. In case of discrepancies between the image and the written product description, the written description prevails.


4. Prices and Payment

Prices

  • All prices are expressed in Swiss francs (CHF).

  • VAT is included where applicable.

  • Valid prices are those indicated at the time of order.

  • Shipping costs are calculated at checkout.

Payment Methods

We accept the following payment methods:

  • Credit/debit cards (Visa, Mastercard, American Express, Maestro)

  • TWINT

Payment is made on a secure server and card details are never stored in our systems.

5. Shipping and Delivery

Delivery Areas

We deliver throughout Switzerland.

  • Fresh truffles: shipped in refrigerated packaging.

  • Preserved and packaged products: shipped via standard courier.

Shipping Days and Times

  • Fresh truffles: Monday to Thursday, 08:00–13:00 (to ensure freshness for the weekend).

  • Preserved products: Monday to Friday.

Indicative Delivery Times

  • Preserved products: 2–3 business days.

  • Fresh truffles: delivery within 24 hours of shipment (in season).

Shipping Costs

Calculated based on weight, volume, and destination. Free shipping for orders over CHF 150.

Special conditions for B2B customers with recurring orders

  • Professional packaging to ensure truffle freshness.

  • Full tracking depending on the selected shipping method.


5.1 Transport and Delivery

Products purchased on the Site will be delivered to the address provided by the Customer during checkout in the “Delivery” field.

All purchases will be delivered by couriers (“Courier”) from Monday to Friday, excluding holidays. Tartufi Marzoli is not responsible for unforeseeable delays or delays not attributable to it.

Once Products are shipped, the Customer will receive a confirmation email.

Delivery is made to the address provided at the time of order. If the address is unreachable or the recipient is absent, the goods will return to the warehouse.


6. Right of Withdrawal and Returns

Preserved Products

The Customer may withdraw from the purchase within 7 days of receipt by emailing tartufimarzoli@gmail.com.
Products must be intact, in their original packaging, and unused.

Fresh Truffles

Due to their perishable nature, the right of withdrawal must be exercised within 6 hours of delivery by email.
Truffles must be repackaged as received and returned with refrigerated packaging.

Return shipping costs are borne by the Customer. Once the product’s integrity is verified, Tartufi Marzoli will refund within 14 days.

The Customer must indicate the product(s), order number, and order date when requesting a return. Customer Service will then authorise the return, and the Customer may ship the goods via courier.

The right of withdrawal applies only to natural persons, excluding purchases by resellers or those buying for resale.

If the terms for withdrawal are not respected, the Customer will not be entitled to a refund or credit.


7. Refund Terms

Upon return, Tartufi Marzoli will verify the conformity of the products.

If approved, Tartufi Marzoli will confirm acceptance via email. Refunds will be processed as soon as possible and in any case within 14 calendar days of knowledge of the withdrawal, after verifying proper execution and acceptance of returned products.

If the payer differs from the recipient indicated in the order form, the refund will be made to the payer.


8. Warranties and Complaints

We guarantee the conformity and quality of delivered products.

To report defects or quality issues, the Customer may email tartufimarzoli@gmail.com with the order number, problem description, and, if possible, photographs.

Possible solutions:

  • Product replacement

  • Partial or full refund

  • Credit for future orders

For fresh truffles, complaints must be sent within 6 hours of delivery.


9. Errors and Liability Limitations

Tartufi Marzoli is not responsible for:

  • Indirect or consequential damages from product use

  • Deterioration due to improper storage

  • Natural variations in shape, weight, or aroma of fresh products

Company liability is limited to the value of the purchased product.

Product information is regularly updated. Tartufi Marzoli is not responsible for errors, except in cases of gross negligence or intentional misconduct.

The Company reserves the right to correct errors or update information at any time without prior notice.

Except in cases of gross negligence or intentional misconduct, the Customer is excluded from any claim for damages, compensation, or liability for direct or indirect damage caused by failure to accept or fulfil an order.


10. Intellectual Property

All site content, including text, images, logos, and trademarks, is owned by Tartufi Marzoli or respective owners and protected by copyright laws.
Use, copying, or reproduction without written permission is prohibited.


11. Changes to Terms and Conditions

Tartufi Marzoli may modify these Terms at any time for:

  • Regulatory compliance

  • Service improvements

  • Company updates

Changes will be published on the site with an update date. Continued use of the site constitutes acceptance of the new Terms.


12. Governing Law and Jurisdiction

These Terms are governed by Swiss law, in particular the Swiss Code of Obligations (CO) and the Data Protection Act (DSG), and specific provisions for food commerce.

The exclusive jurisdiction for any dispute is the Court of Mendrisio (Canton Ticino, Switzerland).
The reference language is Italian, even if the site is available in English, French, and German.

Mediation: mandatory attempt before legal proceedings.

14. Final Provisions

Validity of Clauses

If any provision is invalid or unenforceable, the remaining provisions remain valid.

Priority

In case of conflict between these Terms and any other communication, these Terms prevail.
